FRAUD PREVENTION To prevent the unauthorized use of credit cards, Action Sports / Sportsbay.com may require additional identification prior to the release of an order. SHIPPING AND HANDLING Orders are shipped Mon-Fri excluding holidays. Merchandise prices do not include shipping and handling charges. Estimated S & H charges will appear on the order form before you submit your order. Action Sports reserves the right to correct errors and determine the correct shipping method and cost prior to shipment. When multiple cartons or "oversize cartons" are necessary to ship a purchase, additional charges may apply. Customers will be advised in advance of any changes to their original order. The majority of orders are shipped with Fed Ex, USPS or UPS. If you would prefer a different freight carrier please mention this on the order form and we will do our best to accomodate you, however the shipping cost may vary from what was quoted at the time you placed your order. For items weighing less than 35lbs.,Fed Ex / UPS or US Mail will be used,allow 3 to 5 business days for in stock items. Overnight or two day delivery is available for an additional charge. For items weighing over 35 lbs.(such as mopeds) Motor Freight (Truck delivery)will be used. Allow 7-10 business days. INTERNATIONAL DELIVERY / CUSTOMS / DUTY Canada - Customers are responsible for charges for GST (Customs), Brokerage and duty collection fee which are collected at the time of delivery. International Orders shipped outside the Continental US - Allow 1-3 weeks for sea / ground delivery. For faster delivery (3-7 day) air freight is available and we will provide you with air freight costs prior to processing of your order. Factors such as weight and box size may require freight price adjustments that differ from freight amounts quoted on initial purchase order. Customs expenses are collected from the customer by the delivery service and are not included in the original invoice. Customs charges billed back to Action Sports by the freight carrier will be charged to the customers credit card. APO / FOB Military Orders - All orders shipped with the USPS. Out of state shipments are exempt from California sales tax at this time. CUSTOMER SATISFACTION Action Sports wants its customers to be satisfied and will make every attempt to assist with the quick and fair resolution of any issues that should arise. Limits of Responsibility Ownership of merchandise transfers to the customer at the time it is accepted by the shipping company. Any claims for loss or damage are the responsibility of the shipping company and are subject to their policies. MERCHANDISE All merchandise is guaranteed new and free of defects unless specified otherwise. WARRANTY Action Sports will honor any manufacturer's warranty available on merchandise we sell for our customers. Otherwise, we make no warranty, express or implied, as to the suitability or fitness of any item for any particular purpose. User initiated damage and or loss of parts incurred during operation may not be covered by any warranty. RECYCLING Action Sports believes recycling paper and boxes helps the environment. Whenever possible we will reuse boxes and packaging and avoid using materials that do not decompose easily. RETURNS & CANCELLATIONS Returns for refund,credit or exchange are allowed within 30 calender days of order date on items in new - unused condition in the manufacturers original packaging with all labels and instructions included. No credit or exchange will be allowed after 30 days from order date. Open Box Specials, electrical components for mopeds (coils,condensors,light bulbs,relays) books and service manuals, and thermal underwear are not returnable for refund, credit or exchange. Due to their seasonal nature , ski and snowboard equipment purchased between January 15th and September 1st will not be accepted for refund or exchange. Please Email (Sportsbay@Yahoo.com) or call customer service (510-786-1025 M-F 9-5 PST USA) with your Sportsbay invoice number and the reason for the return. Customer service will issue a return authorization number that must be written on the outside of the package being returned.Packages arriving without a return authorization number written on the outside will be refused. Return authorization numbers are not a guarantee that a refund,exchange or credit will be issued but provide a method of tracking orders. SHIPPING EXPENSE All delivery and return charges are the customers responsibility. Shipping credits provided by Action Sports / Sportsbay during free/discount freight promotions will be forfeited and deducted from final refund,credit or exchange amounts. PACKAGE PICKUP Should you be unable to deliver your package to a delivery service for return we can have the freight carrier pick up the package from you and return it to Action Sports. There is a $10. pickup charge for this service plus return shipping expenses. All boxes must be taped and the contents insulated from damage, the freight carrier will not package merchandise. Contact customer service to arrange for this service. REFUSED SHIPMENT If a shipment is refused by the customer or is undeliverable and returned to the shipper, the customer is responsible for payment of both the original transportation charges, return charges and any additional duties and taxes that may have been incurred. Action Sports / Sportsbay reserves the right to refuse refunds for returned merchandise that does not meet its return criteria or deduct costs associated for returned merchandise that is damaged or missing parts. Items not qualified for refund or merchandise credit will be returned to the customer with an explanation for the action. ORDER CANCELLATION Orders should be cancelled by calling 510-786-1025 M-F 9-5 PST or by emailing Sportsbay@Yahoo.com. Please have your invoice or order number available. A 3% cancellation charge will be applied to processed orders canceled prior to shipment. SHIPPING DAMAGE - SHORTAGES Merchandise should be inspected at the time of delivery and any problems should be brought to the attention of the delivery person and noted in writing on the delivery receipt. Customers must notify Action Sports within 10 days of delivery of any shortages, damage or other problems. In the event of lost or missing merchandise the items in question will be elgible for replacement only. No refunds will be provided. Ownership of merchandise,transfers to the purchaser,at the time a package is picked up by the freight carrier from a Sportsbay/Action Sports location or one of its affiliates.
